A recent Maryland law requires the state's Commissioner of Labor and Industry, in consultation with its Occupational Safety and Health Advisory Board, to develop and adopt regulations that require employers to protect employees from heat-related illness caused by heat stress. Those standards are due by October 2022.
The law also requires the state to hold four public meetings to collect input from residents. This month, the Maryland Occupational Safety and Health Division (MOSH) scheduled those meetings, and I testified at the September 20 session.
As I stated during the hearing, CPR is pleased that Maryland will issue a standard requiring employers to protect workers from heat-related illnesses this session. I and other advocates urged MOSH to address the dangers of working in the heat and the immediate need for the standard.
As noted in my testimony, farmworkers are predominantly Black and brown, and many are from Indigenous and Afro-descended backgrounds, and they often earn wages below the federal poverty level. In addition to our usual picnics and barbeques, we should spend this day uplifting laborers who work in conditions in dire need of regulation — including those exposed to extreme heat or who work in hot environments.
Physical activity makes it difficult for the body to cool itself down, especially as temperatures and humidity rise. The effects can be dangerous, ranging from dizziness, nausea, cramps, exhaustion, and vomiting to faster heart rates and deadly heatstroke. A blog post published last month by the Chesapeake Bay Program, a collaborative partnership focused on Bay restoration, addressed the many ways that the climate crisis will affect farms in the region. Data from the program shows temperatures on Maryland’s Lower Eastern Shore, home to a high concentration of industrial poultry farms, increased between 2 to 2.5 degrees Fahrenheit, on average, between 1901 and 2017. By 2080, temperatures in the Chesapeake Bay watershed are projected to increase by 4.5 to 10 degrees, posing a serious risk of heat stress to farmworkers and livestock.

Asunción Valdivia, a 53-year old father and farmworker at a Giumarra vineyard in California, died after laboring to pick grapes for ten straight hours in 105-degree heat. When he collapsed, his employer told Valdivia’s son, Luis, who was also working in the field, to drive him to the hospital, but Valdivia died before they arrived.
In Valdivia’s memory, on July 10, Reps. Judy Chu and Raúl Grijalva paved the way to protecting outdoor and indoor workers across the nation from extreme heat by introducing the Asunción Valdivia Heat Illness and Fatality Prevention Act (H.R. 3668).

As 2018 ends and we take stock of the developments in workers’ rights over the first half of the Trump administration, there is little forward progress to report. This administration, acting with minimal to no congressional oversight, has consistently neglected to protect America’s workers, instead rolling back and delaying numerous Obama-era regulations and safeguards, ignoring emerging hazards from climate change and new technologies, and restricting traditional inspection and enforcement in favor of self-reporting and compliance assistance.
Instead of focusing on the past and the negative, let’s look forward to 2019. If it wants to, the Trump administration has an opportunity to change course next year, and work with the 116th Congress to prioritize America’s workers. Every day in this country, 14 workers leave for work, never to return home. One worker is killed on the job every two hours in the United States. In 2016, 5,190 workers died earning a living, the highest number on record in eight years. That doesn't account for the hundreds of lives lost daily to occupational diseases from exposures to toxic chemicals and substances. Nor does it include the thousands of hard-working Americans who incur severe injuries or contract illnesses on the job each day.

Scott Mugno, Vice President for Safety, Sustainability, and Vehicle Maintenance at Fed Ex Ground in Pittsburgh, Pennsylvania, is President Trump's pick to head the Occupational Safety and Health Administration (OSHA). Although whispers of Mugno's possible nomination had spread across Washington, D.C., over the past several months, not much has been said about his credentials for the job. One major concern is Mugno's connection to the notoriously anti-regulatory U.S. Chamber of Commerce, for which he is currently the chairman of the OSHA subcommittee of the group's Labor Relations Committee. And as Jordan Barab, former Deputy Assistant Secretary of Labor at OSHA, highlights in his excellent blog post on the nomination, Mugno expressed interest in sunsetting OSHA standards in comments he made at a Chamber event last year.

Last month was the hottest July on record for several cities across the southern United States, thanks to a heat wave that brought extreme temperatures to most of the country. But even when temperatures aren't record-breaking, extreme heat can be dangerous and potentially fatal if proper precautions aren't taken. Between 2003 and 2012, more than 30 workers died annually from heat-related illnesses and injuries, according to the Occupational Safety and Health Administration (OSHA). In 2014, 18 workers died and another 2,630 workers suffered injuries or illnesses related to excessive heat exposure. Yet OSHA has repeatedly declined to adopt a national standard, instead offering guidance to employers on preventing heat-related illnesses.

OSHA published a report (pdf) last week on its role in the federal government’s response to last year’s massive oil spill. Within days of the blowout aboard the Deepwater Horizon, OSHA officials were in Louisiana, working to ensure that the people involved in the response and cleanup had adequate protection from the myriad hazards they would face. The new report is mainly a list of accomplishments, not an introspective “lessons learned” self-evaluation that could have paved the way for policy changes that would improve the federal oil spill response system. Nevertheless, the document is worth the read because it provides a good sense of the difficulty OSHA faced in protecting a huge workforce from so many hazards, as part of an unprecedented government response.
